A working guide to cross-border probate documents

Cross-Border Probate Documents can involve different document checks depending on the receiving authority. Confirm the intended use and destination before arranging translation, a notarial signature, or consular legalization. For a review of your specific estate paperwork moving between Thailand and a foreign probate court matter, contact us on LINE @THAIL or by email at Contact@thailaw-accounting.co.th.

Documents to discuss for estate paperwork moving between Thailand and a foreign probate court may include death certificate, will, heir list / family records, court order, passport of heirs; confirm the final checklist with the receiving authority. Check the current acceptance criteria with the district office, the Thai court and the MFA Department of Consular Affairs.

How the workflow runs end-to-end

First identify the issuing authority, the person signing, the destination and the receiving body's current requirements. The necessary steps may include translation, certification or consular legalization, but not every document needs every step. Confirm the sequence before sending originals.

Frequently asked questions

What Thai documents does an overseas probate court usually require?

Commonly the death certificate, the household registration showing the deceased's record, the marriage certificate or family status evidence, the will if made in Thailand, and any Thai court order appointing an estate administrator. Each is certified, translated, legalized by the MFA and often by the receiving country's embassy in Bangkok.

Is a Thai will valid for assets held abroad?

A will validly executed in Thailand is generally recognised for Thai assets, but overseas courts apply their own succession rules and may require a separate grant. Many families keep one will per jurisdiction, carefully drafted so they do not revoke each other. Take local advice in the country where the asset sits before relying on a single document.

Who can be appointed estate administrator in Thailand?

A Thai court appoints the administrator on petition by an heir or an interested party, and the order is what banks and land offices act on. Foreign heirs can be appointed but must appear or act through a lawyer with a legalized power of attorney. We prepare and legalize the documents the petition and the foreign court both need.

How long does the document chain take?

Certified translation is usually two to four business days, MFA Consular legalization two to three business days, and embassy legalization a further one day to two weeks. Obtaining a Thai court order is a separate matter measured in months. We report each stage so the overseas solicitor can plan filings around real dates.

The deceased died overseas. What must be done in Thailand?

The foreign death certificate is apostilled or legalized in the issuing country, translated into Thai, and legalized by the MFA or the Thai embassy abroad before Thai banks, the land office or a Thai court will act on it. Thai district offices may also require registration of the death for a Thai national.

Can you work directly with our solicitor overseas?

Yes. We routinely take instructions from overseas law firms, report in English, supply scanned certified sets ahead of the couriered originals, and issue formal invoices. A single case manager keeps the correspondence in one thread so the file does not fragment across time zones.
